Tadeco Bucor Joint Venture Agreement - Further
Presidential Decree 1585
(a) that when the national interest so requires, the President of the Philippines may review, amend, modify, revise, rescind or revoke any such contract, concession, license, permit lease or similar privilege or any condition or provision therein;
(b) that, upon the recommendation of the government agency or instrumentality concerned with the administration of any such contract, concession, license, permit, lease or similar privilege, the President may, pending the conduct of appropriate hearing, summarily suspend and order the cessation of all activities and operations under the contract, concession, license, permit, lease or similar privilege for violation of any condition prescribed in duly issued rules and regulations of the administering government agency or instrumentality.
DOJ Secretary Aguirre wants the president to invoke the above PD for the cessation of the Tadeco-Bucor JVA.
Well, his surprised look during the congressional inquiry, upon reading a portion of the Philippine Constitution, provides a glimpse of how he is prepared and familiar with the laws that his committee used to claim that the JVA is illegal. He even wants to further review the contract. Then, because realizing that voiding the agreement will be a drawn out losing battle for the government in the courts of law, he feeds the above PD1585 to urge our dear President Duterte to cancel the agreement.
For section a1, an agreement can be revoked, rescinded, etc. when it is of national interest. Is it now a national interest to rescind an agreement that provides livelihood to thousands of workers and provides restorative rehabilitation to national inmates? Is this what is happening in the country now? Equating the ill-motives of a few to national interest. And to think that these few are supposed to protect the workers and citizens of this country. I don't think just because it is recommended by a secretary, who got a copy of a report of a team who had never set foot in the plantation, and who got influenced by a speaker of the house, who has ill-motives to the workers, especially those under his congressional district, who are working in Tadeco, that any matter which cannot be proven to be null and void can become a national interest and the president will just sign in the dotted line with a blind eye. Well, the nation is really interested in this drama which may be dragged into a teleserye - mao siguro ni ang bag-ong definition sa "national interest".
For section 1b of the decree requires that a violation is present to any condition prescribed in duly issued rules and regulations of the administering government agency or instrumentality. Is it now a standard that any law can be misinterpreted so that an agreement can be declared null and void? What are the violations of the agreement? Are these violations, if ever there is, tantamount to the removal of the right of the workers to earn and live a decent life?
Thus, we appeal to President Digong to please look at this issue with fairness. Please hear the pleas of your countrymen who just want to live productive and peaceful lives that we deserve.
